An architect designed apartment Vestre Plant in Herning has been the center of a year-long, bitter arvestrid between two of the city’s real estate.

The 136-square-foot apartment belonged to the brokers, the 83-year-old, demented mother, but shortly before her death in January 2013, sold the younger brother, Niels Kofoed from EDC agents in Herning, the opportunity cost to itself.

the Trade that happened just a few hours before his mother’s death, was declared invalid in a byretsdom from June 2017. In the 28-page decision terminating the Right of Herning purchase, because Niels Kofoed as a guardian for his dying mother actually acted with itself.

He appealed the case, which should have run in the Vestre Landsret to June, but he has now decided to drop it. And I am the younger brother of Per Kofoed, who originally brought the case against his younger brother.

– Now I can start sleeping again at night. In the six years I have woken every night with thoughts of the here case, he says.

in Addition to the sale of the apartment trades dispute also about the huge sums of money, as Niels Kofoed on his mother’s death, transferred to his own two children and her sister’s child. Money, as they were ordered to pay back.

Per Kofoed was also disagreed with his brother Niels Kofoed and his sister Jette Fuglsang-Kobberø whether the mother was demented. Niels and Josie felt that she was not demented. It struck retslægerådet, however, that she was.

In total, Per won six cases against its siblings, nieces and nephew, but in spite of that, there now is set of the sentence in arvestriden, he doesn’t feel that there has been something to celebrate.

– It is a strange empty feeling I have now. Yes, I have won, but I have also lost much.

– I did not know how I would handle it. I just felt such a weird emptiness. It wasn’t anything to jump up and down and cheer, it was not, says Per Kofoed on the day, where his lawyer said that the appeal is dropped. Photo: Ernest van Norde

Pers relationship with his brother and sister and their children have suffered irreparable damage.

Per and Niels Kofoed, who otherwise worked together as real estate agents in the same company for more than 25 years, does not speak of that today.

I hope, we come to a day. I have stretched out my arm, so if only Niels would now acknowledge that he has lost, he says with a weak sigh.

Though the apartment now goes back to the nest after the mother, and Per Kofoed on the way to get a larger share of the inheritance, it has been an expensive affair.

He has used the button 650.000 dollars and has only been awarded to around a third in legal costs.

– There is not any think of, to not get near it, as it costs even if you win, he says, and tells that he has drawn on his retirement savings along the way.

– You may well be right, but if you can’t afford to get right, so you lose.

As Extra the Blade the first time mentioned the matter in 2017, would neither Danish Ejendomsmæglerforening or EDC, which lent its name to the Niels Homeless store in Herning, denmark, to comment on the case.

They justified this on the grounds both that the matter was still before the high court. In the day, however, it is not much different, even though the appeal case in the court of appeal is dropped.

– It is a private matter, it has nothing with the EDC to do. So it is not something that we have no position on, that is what we have courts for, says the chief communications officer of the EDC, Jan Nordmann.

So it is not going to have any influence on Niels Homeless seem like the EDC broker?

– It is not something we have taken a position, and that this is a private succession. We are a ejendomsmæglerkæde, and we concentrate on our customers.

In the trade organization Danish Ejendomsmæglerforening is not much to go into in the case, even though the now is finally completed.

When it concerns a private arvestrid, so it is not something that we as a trade association to comment on, says the association’s deputy director, attorney Anders Palmkvist.

even though the arvestriden is all about buying and selling real estate?

– No.

Ekstra Bladet has spoken with Niels Kofoed, who confirms that he has dropped the appeal against his brother, but have no further comments.
