The right-wing conservative government in Austria wants to enforce detention for potentially dangerous asylum seekers. For the law the Constitution should be changed, because it touches on the fundamental rights.
Minister of the interior, Herbert Kickl of the right-wing FPÖ’s response to an incident in Dornbirn, Austria. At the beginning of February stabbed there as a dangerous for the well-known asylum seekers, the head of the division of social services. The alleged perpetrator is currently in custody.
“’t have to go over the courts”
The restrictions would relate to asylum seekers, which are considered to be a threat to public order. “Austria would not be far from the first country in the EU that allows such a measure, legally,” said Kickl. To him be important that the authority could impose the detention and the need to not take “the opposite way, first through the courts”. “I’m afraid that the candidates for this security measure in question, are then submerged.”
The move is controversial – even within the government. Chancellor Sebastian Kurz was behind the plans – “of course in a legal framework, with judicial checks and only in case of concrete suspicion”. Minister of justice Josef Moser of the ÖVP, however, the detention on the critical. Such freedom was a deprivation of “extremely sensitive,” he told the ORF.

experts report fundamental concerns when it comes to potentially dangerous asylum seekers without a criminal Offence to imprison. “How to be found such a risk reliable? It would open the floodgates to despotism,” said the Austrian constitutional lawyer Bernd-Christian Funk.
For a constitutional amendment a two-thirds majority in Parliament is necessary. The black-blue government would be dependent on the Opposition.
the Opposition will not be moving in with
The SPÖ has in this question, no single line. Some in the group values the thrust of Kickl as a distraction from a possible authorities in the killing of Dornbirn failure in the case. Party leader Pamela Rendi Wagner wants to set up a working group on the safety of detention, should also examine whether the existing laws are sufficient.
A backup of imprisonment would be legally extremely tricky, also criticized the Federal President, Alexander Van der Bellen of the plans. “Excuse me? Deprivation of liberty? This is probably one of the worst things that are possible. You must watch very well.” A bill for securing detention for a possible attacker wants to let Van der Bellen.
