The irish fast food chain Supermac’s has won a case against the american company in the European union immaterialrättsmyndighet (Euipo) where they wanted to two of Mcdonald’s brands would no longer be protected.

Mcdonald’s has in the past successfully managed to stop Supermac’s from establishing themselves in the Uk and the rest of Europe and argued that the irish name was too similar to the hamburger the Big Mac. The company accused Mcdonald’s of varumärkesmobbning and to register trademarks that they are not using, but only have ready when the future competitors.

Mcdonald’s has not proven that they actively use the marks as a name on a hamburger, or a restaurant.

“We wholeheartedly welcome the decision as a proof that small companies can stand up against global giants everywhere,” says Supermac’s managing director Pat McDonagh.

Mcdonald’s can appeal the decision.
