André Martin was in Wevelgem on his bike hit by a truck coming from the Kortrijkstraat opdraaide to the highway E403. Trucker Nicolas R. had ‘m not seen. The cyclist was a few metres swept away and became badly injured. He was spot resuscitated but died several hours later in the hospital. The dossier was at the beginning of april, called for the City magistrates ‘ court. The beklaagdenbankje, however, remained empty. “My client lives five to six hour drive from here, it is too far to go to Kortrijk to come,” explained his lawyer. “His employer would not want that he make the effort to have to attend court.” The questionable frown on the face of the magistrate made it clear how poorly they do this, but could appreciate.

Cyclist was clearly visible

The verkeersdeskundige that the accident is investigated, came to the conclusion that cyclist André Martin is indeed visible to the trucker. “Partially, but sufficiently visible’, reports the expert report. “The sun was indeed annoying, and that required a high aandachtsniveau of the trucker, but the accident was very avoidable.” The magistrate followed the findings. They condemned R. to a driving ban of three months, a fine of 2,000 euros and a suspended sentence of three months. His employer has to pay the compensation to the relatives of the cyclist.
