“Study: Migrants are judged harsher for sex crimes”
“A new study suggests that young new arrivals are judged on more vague grounds of sex crimes than Swedish adolescents. They are also assessed as less credible in questioning than Swedish youths, despite identical circumstances.”
“the Study is made by Katrin Lainpelto, associate professor in procedural law at Stockholm university. She has let judges and jurors take part of the identical conditions in a contrived sexual harassment, with the only difference that in the one case, the suspect was called Erik and was born in sweden, and in the second Mudahafar, who spoke broken Swedish. The background to the study is the discussion around the refugees and the debate around the newly arrived young people as a special risk group for sexual offences.”
“in Spite of the identical conditions, the differences observed in how the judges and the lay assessors assessing the events described, and the credibility of the interrogated. Especially in nämndemannagruppen were differences in the assessments.”
“A fake case with a vague evidence conditions in which the word stood against word was recorded in two versions. In one case, with a Swedish young guy, Erik, who suspected, and the other with Mudahafar, an immigrant guy who broke. The data provided in the interviews were identical.”
“34 juristdomare and 320 jurors got to listen to the stories and assess the events and the credibility.”
“the Researcher has also studied the tingsrättsdomar from the years 2013, 2015 and 2017, where young people have been prosecuted for sexual molestation. 2013 and 2015 was no relationship between ethnic background and assessment of guilt, but 2017 was found a such. Young people with a Swedish background was acquitted in 30 per cent of the charges, while the corresponding figure for those with foreign background was 3 per cent. The judges were also investigated qualitatively, and the differences were found. In the case of the accused with a foreign background were more words against ordsituationer, while there was more forensic evidence in the case of the Swedish youth.”
