An EU court has upheld the complaint of a number of European cities against EU exhaust emission limits. For the drivers, everything remains as it is – at least for the time being.
With the verdict, nothing will change for German drivers only once: In the dispute, it comes to limit values for exhaust gas tests. In response to the exhaust gas scandal, these Tests are carried out not only in the laboratory, but also on the road. The use of manipulation software you should be prevented.
For these new emissions tests had lifted the EU-Commission in 2016, with the limits that applied in the case of laboratory tests for Euro-6 Diesel – so less strict limits set. The laboratory values were often much lower than the actual emissions.
laboratory exhaust measurements do not give the real values in road traffic.
the EU Commission exceeded competence
The EU court did not agree. The Problem is that The original limits had the European legislator laid down – so the EU Parliament and the member States. The EU Commission was not allowed to change the limits now alone. The judge requested the Commission, the European Parliament and the member States, new rules.
consequences, as yet, unclear
Whether and how the limits at the end of change, is still open. For a total of 14 months, the time is now, as long as the old limit will continue to apply. The process could drag on in addition, yet longer, if the EU pulls Commission in the next instance before the European court of justice.
