The Federal court has upheld a complaint of an air traffic Manager of Skyguide. The judges acquitted him from the charges of negligent disruption of public transport.

In a media release of the night on Friday Skyguide showed himself satisfied with the verdict. The Organisation was, however, convinced, in spite of this positive acquittal of that in the Swiss law a framework for the aviation permanently practiced culture of safety “Just Culture” is fixed, should be, was it more.

So should it be employees, the law allows you to report mistakes without disciplinary consequences if this had not been wilfully or grossly negligently.

Two start free

the Background to the complaint in the Federal court case was from March 2011 at the Zurich airport. Two machines were given in quick succession at the start of a share on the intersecting runways 16 and 28. The aircraft on runway 16 was launched, as planned, while the machine is on runway 28, he broke the Start.

The involved air traffic controllers from Skyguide had to answer as a result of the incident in front of the district court of Bülach and was acquitted. However, the prosecution lodged an appeal and took the case to the Zurich high court. This spoke to the man but guilty of what he submitted is now successful in his appeal to the Federal court.
